Possibly stolen Russ. Have you reported it to the police ?

Showing as "no mot" It ran out on the 18th of this month. So it maybe just dumped !

Yep I found it on Saturday on my solo rideout, when I got home phoned 101 and was put on hold for twenty minutes before giving updisbeliefno then phoned a friend in the force and reported it that waysmile then when we went passed it yesterday we mentioned it to the farmer who was just opening the gate above it and he said he had also spoken to the police and they weren't interested and had told him to speak to the council, so I guess that means its not been reported stolen so possibly dumped!! who knows! windows down but ignition still intact, so not sure.

That car's MoT is expired so it should not be parked on a highway!

Is this a possible lane subitage? You would think for £80-£120 scrap you would have it taken away for you? Weird one.

Not sure that's a true statement.

Obstruction of the Queen's Highway is surely an RTA offence?

Why is that not a true statement?  confuse

If the vehicle is not insured, taxed or has no MoT (if it requires one) then it is illegal for it to be parked on the Queen's highway.

If it has no MoT but is taxed then the insurance will most likely be void and similarly should not be left on a highway.

I once found a car dumped at the northern end of 202-153 that we couldn't get past so had to back-track. I e-mailed the council to report it and said that if it had had a sterring wheel we'd have removed the obstruction by pushing it out of the lane and onto the wider tarmac road (Long Road). Council man waspishly told me I'd then be guilty of dumping a car on the public highway. I pointed out to him that it was already on the public highway. No more was heard but the car disappeared.

Cheers,

John

An MOT is a certificate of road-worthiness & thus if a car is over 3 years old then its requried to have an MOT before you drive it (or are on your way to a pre-scheduled MOT inspection).

The no MOT so insurance void is haer-say only (unless specified on your policy).

So as far as I understand you have full untitlement to park a car on a highway with no MOT (as long as taxed/insured).

Of course the blocking of the highway is another matter - but thats not the matter I'm debating.

Feel free correct/debate as necessary.

Wheely, if you read this report HERE, you will see that for a car to be on a highway it needs to be insured AND have an MoT (if required) to be legal. confuse

The above is a report of an actual 1995 court case where it concludes "It is submitted that it also makes good law, inevitable when a car has no MOT it more often than not has no insurance, or vice versa. Proving one set of facts should aid prosecutions"

Good info - would be nice to see a case where it was just an MOT that had lapsed and vehicle not driven only parked (as in this case the car was also uninsured, which I know is illegal to leave parked on a highway).

All dvla and other references refer to driving without MOT -- and SORN is for either tax or insurance but doesnt mention MOT.

You'll be pleased to know all my vehicles are MOTed and my road is private. So my debate isn't one of personal interest. Just like arguing really

Ditto, Wheely.

I'm not "getting" at anyone ~ it's just that I've always observed the main rules of the road and regard my licence as a privilege.

I do, however, admit to exceeding the speed limit on a few occasions, and I've been know to have the odd bike with similar numbers, but generally all insured, MoTd and taxed.

When all's said and done, one can do whatever's wanted because it's only illegal when (and if) you get caught. biggrinbiggrin

The council only seem interested in the road tax.

You should have rode it Russ, would have made good trials practice
