Motorcycle Parking in Beer Part 5 Signs are not Legal


Following the debacle of motorcycle parking in Beer,  There has been much discussion by various motorcycle groups.  As for Cllr Chubbs statement that bikers were respected by EDDC the latest sign concerning bike parking at the bottom of beer street now contains a warning that if you damage or deface the sign you are committing an offence.  So so much for bikers being trusted if EDDC put warnings on the bottom of signs.  They have not put such warnings on the bottom of car parking signs, as for the expense of the third set of signs this year who is paying one asks, not the horrible woman who lives at Beach House instigated it all

Many bikes that have been parked in the carpark have been robbed or damaged, and this has got some of the local bike clubs to seek action

Update on the situation re the signs that have been erected on the space that bikers usually park on at the bottom of Fore Street, Beer. I have had confirmation from Devon District Council that they are not legal as they do not conform to highway signage rules and regulations. I am waiting to hear from East Devon District Council now as to what they propose to do, watch this space!

 

So as far as can be ascertained bike parking at present is legal at the bottom of Beer street

JCB are keeping up the pressure on EDDC could the DTRF put some more on, or if nothing else put complaints in about the large flower pots outside Beach house which are obstructing the pavement at one of its narrowest points

It would be nice to know what leverage the old woman has over EDDC as she lives in Axminster, Beach House is a holiday home and she is only there a couple of days a week and has only owned it for a short while, how was it she was able in a short period of time to get the council to place signs banning bikes, against the wishes of local business and the Parish Council

Latest update from Jilly at JCB,  makes interesting reading

 

Update on the Beer parking situation, and it's as clear as mud which is as much as it stinks!!
East Devon District Council erected the signs to 'deter' bikes from parking on the space, as they own the land. They are responsible for the car parks in Beer but NOT responsible for on/off road parking. Devon County Council are responsible for on/off roadside parking and say catergorically that the signs are not legal. EDDC told me this pm that as they own the land they are entitl...ed to issue fines of £50/£70 for parking there. When I said "but it's not in the car park it's the paved area outside" she replied "oh I don't know then" and when I asked what the £50/£70 fine would be for she replied "sorry I don't know". Marvellous!!! I am now going to the Midweek Herald over this and see what they can do, it's ridiculous. EDDC have also said that people were "compelled to leave the pavement and walk in the road" because of the parked bikes but we have a photo of a family of five with a pram walking up by our bikes, all on the pavement. I was also told that Beer Parish Council had complained about the danger of bikes parking on this space which I don't believe is true. Anyway onwards and upwards, I don't give up easily!!

If anyone has piccys of bikes parked on the space at the bottom of Beer, please lets have them so we can prove that bikes do not cause an obstruction.  Or could everyone please put in objections to EDDC concerning the flowerpots on the pavement outside Beach House which are causing obtructions and cause people to have to walk in the road.  Funny how its the woman who complained about bikes is responsible for the flower pot obstruction.

 Where the bikes park is not on the pavement. Devon County Highways are responsible for pavement, there are a line of bricks which mark the end of their responsibility,  EDDC are responsible for the car park, the piece where bikes park is neither pavement or carpark!!

Read on:

Local authorities (in England) can make an order prohibiting parking on the pavement. If this is the case, then there will be signs which clearly point out on a particular road where parking on the pavement is specifically prohibited. The penalty for contravening this will be a fixed penalty notice.

Otherwise, parking a vehicle on the pavement could lead to an offence of obstruction being committed. This could result in a fixed penalty notice being issued to offending vehicles. It can also cause danger/nuisance for pedestrians and wheelchairs users.

Note that it is an offence to drive on the pavement, yet despite the obvious inference that a parked vehicle has been driven on the pavement prior to being parked there, witnesses to the driving will probably be needed to secure a prosecution - this can be problematic.

Note that whilst the above information represents the general position in England and Wales, there may be regional variations to this, for example, in London there is essentially a blanket ban.

We used to go down to Beer on both road bikes and trail bikes about half a dozen times a year, but not any more. We would eat at the splendid Duckies Cafe on the beach and buy our petrol at Seaton Down Hill petrol station. But we go to the north coast now and eat at the equally splendid Driftwood cafe in Blue Anchor with absolutely no hassles with parking.
There are still some legal unsurfaced roads to ride to get there from South Somerset as well.
Well done EDDC you have deprived local buisnesses around Beer of our cash and put it into West Somerset.

 I think we should park some bikes there and wait to see what happens, i do not mind spending time for the cause, and i might have to move some pots as well !! biggrinbiggrin
